Hold Harmless: All guests give up their right to sue Chin Up Chest Out Enterprises, LLC or any of it’s associated companies, and agree to hold CUCOE or any of it’s associated companies harmless from any and all liability for personal injury, property damage or wrongful death caused by negligence or gross negligence. Guests assume all risks in connection with the commercial boating activity of Chin Up Chest Out Enterprises, LLC or any of its associated companies.

Swimming: Swimming comes with inherent risk of drowning. Customer acknowledges that they are aware there is NO LIFEGUARD ON DUTY, and swimming is at your own risk. You agree that Chin Up Chest Out Enterprises, LLC will not be responsible for any injuries sustained by you the customer and/or customer’s occupants or guest while swimming.

Customer liability for damages

1. Customer acknowledges that they will be held liable for any damage done to the watercraft or associated accessories, if damaged by the customer, or their party.
2. Customer acknowledges that they are liable for the cost of the broken equipment and associated repair costs at $150 per hour, if customer or customer’s party damages the watercraft or accessories in any manner.
3. Customer acknowledges that if they fail to reimburse Chin Up Chest Out Enterprises, LLC for damages incurred from the customer or customer’s party, that charges will be brought against the customer by Chin Up Chest Out Enterprises, LLC.

Jumping off the boat while engine(s) are running

As we pride ourselves in safety, customer understands that if they, or someone from their party jumps off the boat while the engine(s) are running, their charter is over. Customer will forfeit all charter fees, as well as captain’s service fee will be charged to the card on file. The captain will give you instructions on when you can get in the water once boat is properly anchored or docked. 

By booking a Charter/ Rental, the customer agrees to all terms and conditions.
